Fidelity Investments — This is insane as I am her mother

My daughter’s father passed away and left my daughter who is 17 1/2 of his 401k account with Fidelity. I have talked to them repeatedly and sent in all information requested as in daughter’s birth certificate, my marriage license (to show I am the party on the birth certificate since I re-married) as well as all evidence of the passing of her father as I am also the administrator of the estate. I am trying to rollover the funds from this account to an investment account for my daughter. Fidelity is stating that unless I go to the court and get a document stating I am my daughter’s legal guardian , that they will not lift the stop on the account or grant me the access to complete the rollover until my daughter is 18. This is insane as I am her mother, I have provided all documentation proving this to them and I do not believe I should have to pay $300 to go to court for legal guardianship when the court has recognized me as her guardian in the probate filing and I also was able to complete successfully the application to receive social security benefits on my daughter’s behalf.
